Terms of Use

Welcome to Ourguid.com, the website and online service of Ourguid ("Ourguid", "we", or "us"). This page explains the terms by which you may use our online service, website and software (together, the "Service"). By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms of Use, and to the collection and use of your information as set out in our Privacy Policy and Cookie Policy — whether or not you are a registered user. These Terms apply to all visitors and users of the Service.

Who can use the Service

You may use the Service only if you can form a binding contract with Ourguid, and only in compliance with these Terms and all applicable laws. You confirm that you are at least 18, or at least 16 with the permission of a parent or legal guardian who takes responsibility for your compliance with these Terms. Use by anyone under 16 without such permission is not allowed. The Service is not available to users previously removed by Ourguid.

Creating and using an account

Your account gives you access to the features we make available from time to time. If you open an account on behalf of an organisation, you represent that you are authorised to bind it to these Terms. You may never use another user's account without permission. When creating your account you must provide accurate and complete information. You are responsible for the activity on your account and for keeping your password secure — we encourage a strong password. Notify us immediately of any breach of security or unauthorised use; Ourguid is not liable for losses caused by unauthorised use of your account.

Controlling your account

You control your profile and how you interact with the Service from your Settings page. By giving us your email address you consent to us using it to send Service-related notices, including any required by law, in place of postal mail. We may also email you about new features and offers; you can opt out or change your preferences in Settings.

Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use and only as permitted by its features. Ourguid reserves all rights not expressly granted and may terminate this licence at any time.

Except for your own content, the Service and all materials in it — software, images, text, graphics, logos, trademarks, copyrights, audio, video and content belonging to other users (the "Ourguid Content") — and all related intellectual-property rights are the exclusive property of Ourguid and its licensors, and are protected by applicable intellectual-property laws.

Access to the Service

We do not provide the equipment to access the Service; you are responsible for any third-party fees (for example, your internet provider's charges). We may modify or discontinue any part of the Service without notice, and will not be liable for doing so.

Fees

Paid lessons and packages are priced on individual teacher profiles, which we may update from time to time. Payments are handled securely by Stripe. How lesson hours, cancellations and refunds work is set out in our Refund & Payment Policy.

Privacy and security

We collect registration and other information through the Service; our collection and use of it is governed by our Privacy Policy. We care about the security of your information but cannot guarantee that no unauthorised third party will ever defeat our measures — you provide your information at your own risk.

Lesson recording

You acknowledge that Ourguid may record videos of your lessons, solely to help ensure the quality of lessons and tutoring. Recordings are not shared externally, used for individual targeting, or used for sales, marketing or promotion.

Disclaimer of warranties

Your use of the Service and its content is at your sole risk. The Service and its content are provided on an "as is" and "as available" basis. We and our suppliers and licensors disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Limitation of liability

To the maximum extent permitted by law, in no event shall Ourguid, its affiliates, agents, directors, employees, suppliers or licensors be liable for any indirect, incidental, special, consequential or exemplary damages, including damages for loss of profits, goodwill, use, data or other intangible losses.

Copyright complaints

We respect content-owner rights and respond to notices of alleged infringement, including notices that comply with the Digital Millennium Copyright Act ("DMCA"). Send copyright notices to:

Legal notices

Who you are contracting with: Ourguid, established at Winselingseweg 10 A52, 6541 AK Nijmegen, The Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 98099698.

Governing law: these Terms are governed by the laws of the Netherlands. If you are a consumer living in the European Union, you also keep the protection of the mandatory consumer laws of the country where you live.

Disputes: if we cannot resolve a dispute informally within 30 days of you contacting us, it will be submitted to the competent court of the district of Gelderland, the Netherlands, unless mandatory law gives you the right to bring the claim before the courts of your own country.
